This Privacy Policy explains how Hearts Dream Design LLC (“Hearts Dream Design,” “Company,” “we,” “us,” or “our”) collects, uses, stores, shares, and protects information when you visit or interact with heartsdreamdesign.com, communicate with us, subscribe to our newsletter, inquire about artwork or licensing, follow links to products or third-party marketplaces, or use products, services, courses, workshops, educational materials, downloads, or other offerings that we may make available from time to time.

Hearts Dream Design LLC is a California-based art and surface-pattern design studio. The Site may feature original artwork, surface-pattern design collections, licensing opportunities, educational or creative content, newsletter communications, links to products sold through third-party marketplaces or fulfillment partners, and other creative products and services.

By using the Site, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please discontinue use of the Site.

1. DEFINITIONS

For purposes of this Privacy Policy, “Company,” “Hearts Dream Design,” “we,” “us,” or “our” means Hearts Dream Design LLC and heartsdreamdesign.com.

“Content” means written, visual, video, audio, downloadable, digital, or other material appearing on or distributed through the Site. For Hearts Dream Design, Content may include artwork, illustrations, surface-pattern designs, collections, photographs, graphics, blog or journal content, newsletters, licensing information, educational materials, courses, workshops, guides, downloads, forms, worksheets, and other creative materials.

“Personal Information” or “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an identifiable individual or household, as applicable under relevant law.

“Site” means heartsdreamdesign.com and its associated pages, forms, landing pages, subpages, and other web-based features operated by Hearts Dream Design.

“Services and Products” includes services, products, content, or offerings made available by the Company now or in the future.

“You” or “your” means a visitor, subscriber, customer, licensing prospect, client, student, purchaser, or other person interacting with the Site or Company.

2. WHO WE ARE

The Site and its original artwork and Content are owned or controlled by Hearts Dream Design LLC and/or Julia Cuyler, except for materials identified as belonging to third parties.

Hearts Dream Design is an art and surface-pattern design business that displays artwork and design collections, provides information concerning artwork licensing, communicates with subscribers and prospective clients, and may offer products, educational materials, courses, workshops, downloads, or other creative services.

We are committed to handling Personal Information responsibly and in accordance with this Privacy Policy and applicable law.

3. INFORMATION WE COLLECT

The information we collect depends on how you interact with the Site.

INFORMATION YOU PROVIDE DIRECTLY

We may collect information that you voluntarily provide, including your name, email address, telephone number, business or company name, website address, mailing or shipping address, billing information, information entered into forms, messages and correspondence, newsletter subscription information, comments or responses, order or transaction information, information necessary to provide a requested product or service, account information if accounts are offered in the future, and other information you voluntarily provide.

If you contact Hearts Dream Design concerning artwork or surface-pattern licensing, we may also collect information about your company, project, product category, desired artwork, territory, distribution, proposed usage, licensing period, production quantities, budget, deadlines, and other information relevant to evaluating or administering a potential license.

Please do not submit sensitive Personal Information through ordinary Site forms or email unless we specifically request it and provide an appropriate method for doing so.

NEWSLETTER INFORMATION

The Site will provide an opportunity to subscribe to the Hearts Dream Design email newsletter. Hearts Dream Design currently uses Kit (formerly ConvertKit) as its email newsletter service provider.

When you subscribe, information such as your name, email address, subscription status, signup source, and information associated with delivery or interaction with our emails may be processed by Kit on our behalf.

We may use newsletter information to send newsletters, studio news, artwork and collection updates, educational or creative content, product or service announcements, licensing-related news, promotions or special offers, and other communications related to Hearts Dream Design.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in those emails or by contacting hello@heartsdreamdesign.com.

We may still send non-marketing communications when reasonably necessary to respond to you, administer a transaction, fulfill a contractual obligation, or address a legal or security matter.

INFORMATION COLLECTED AUTOMATICALLY

When you visit the Site, certain technical and usage information may be collected automatically through the website platform, hosting infrastructure, built-in analytics, cookies, or similar technologies. This information may include IP address, approximate geographic location derived from an IP address, country or general geographic region, browser type, device type, operating system, screen or device information, referring website or page, pages viewed, session activity, approximate visit dates and times, interactions with Site features, traffic and performance information, and cookies, local storage, or similar technologies.

Hearts Dream Design currently uses the analytics and technical functionality provided through its Hostinger website platform rather than separately representing that Google Analytics, advertising pixels, heat maps, or similar third-party behavioral-advertising systems are in use.

We may use this information to understand Site traffic and performance, troubleshoot problems, improve navigation and user experience, maintain security, and understand generally how visitors use the Site.

If Hearts Dream Design later adds separate analytics, advertising pixels, heat-map software, behavioral advertising, or other material tracking technology, this Privacy Policy will be updated as appropriate and any consent or opt-out mechanisms required by applicable law will be provided.

4. WHEN WE COLLECT INFORMATION

We may collect Personal Information when you visit or browse the Site, subscribe to a newsletter, complete a contact or inquiry form, contact us by email or another communication method, inquire about licensing artwork or surface patterns, request information, a quote, or other services, purchase or request a product or service, register for a course, workshop, event, or educational offering if those become available, download a resource if downloads become available, create an account if accounts become available, participate in a survey, promotion, or other Site feature, interact with emails we send where applicable, or otherwise voluntarily provide information to us.

You generally may browse publicly available portions of the Site without directly providing your name, email address, or other contact information.

5. HOW WE USE PERSONAL INFORMATION

We may use Personal Information to operate, maintain, secure, and improve the Site; respond to questions, requests, and correspondence; provide requested information; administer newsletter subscriptions; communicate with subscribers; provide customer service; display and manage artwork and surface-pattern collections; respond to licensing inquiries; evaluate proposed licensing arrangements; prepare, negotiate, administer, or enforce licensing agreements; provide quotes or proposals; issue and maintain invoices and business records; provide products, services, courses, workshops, or educational materials; process transactions when purchasing becomes available; administer customer or student accounts if those features become available; personalize or improve user experience; understand Site usage and performance; prevent fraud, abuse, unauthorized activity, or security incidents; maintain legal, accounting, tax, and business records; enforce contracts, licenses, policies, and legal rights; comply with applicable laws and legal processes; and carry out other purposes disclosed when information is collected or with your consent.

Submitting a licensing inquiry to Hearts Dream Design does not grant a license or transfer any copyright, trademark, ownership interest, or other intellectual-property right. Any artwork license must be established separately through applicable written licensing terms or agreement.

We will not use Personal Information for materially different purposes without providing any notice or obtaining any consent required by applicable law.

6. EMAIL COMMUNICATIONS AND CAN-SPAM

Hearts Dream Design may use email to provide its newsletter, studio news, artwork and collection announcements, licensing information, educational content, product information, promotions, and other business communications.

In accordance with applicable commercial-email laws, including the CAN-SPAM Act where applicable, we endeavor to accurately identify the sender, avoid materially false or misleading subject lines, appropriately identify commercial messages when legally required, provide required business contact information, provide a functioning method for unsubscribing from marketing emails, and honor valid unsubscribe requests as required by law.

Marketing emails sent through Hearts Dream Design’s newsletter service will provide an unsubscribe mechanism.

You may also request removal from marketing communications by contacting hello@heartsdreamdesign.com.

Unsubscribing from marketing communications does not necessarily prevent us from sending transactional, contractual, customer-service, licensing, legal, or other non-marketing communications that are reasonably necessary.

7. COOKIES AND SIMILAR TECHNOLOGIES

Cookies are small files or pieces of information stored or accessed on a device that can enable websites and service providers to recognize a browser, maintain functionality, remember preferences, enhance security, or understand website activity.

We and our service providers may use cookies or similar technologies for essential Site functionality, security, maintaining sessions, remembering preferences, measuring traffic and Site performance, understanding Site interactions, improving Site experience, newsletter or form functionality, and shopping-cart, checkout, or account functionality if such features are added in the future.

At launch, Hearts Dream Design expects to use the functionality and analytics associated with its Hostinger-hosted Site and its Kit newsletter service.

You may be able to restrict or disable cookies using your browser settings. Doing so may cause portions of the Site to function differently or prevent certain features from working.

If non-essential cookies or tracking technologies requiring consent are added, we will provide cookie notices, consent controls, or opt-out mechanisms where required by applicable law.

8. DO NOT TRACK AND PRIVACY PREFERENCE SIGNALS

Some browsers provide “Do Not Track” (“DNT”) signals or other privacy preference mechanisms. Because there is not a single universally implemented standard governing all browser-based DNT signals, websites and service providers may respond to these mechanisms differently.

Hearts Dream Design does not currently use its Site for third-party behavioral advertising or intentionally deploy advertising pixels for the purpose of tracking visitors across unrelated websites.

Where applicable law requires recognition of a legally valid opt-out preference signal, such as a qualifying Global Privacy Control signal, we and our applicable service providers will endeavor to honor such signals as required by law.

If our tracking or advertising practices materially change, we will update this section and provide legally required controls.

9. SOCIAL MEDIA AND EXTERNAL PLATFORMS

Hearts Dream Design maintains or may maintain a presence on social-media platforms and provides or may provide ordinary external links from the Site to social-media pages used to display or promote Hearts Dream Design artwork and studio activity. These are external links rather than embedded social-media feeds on the Site at the time of this policy.

When you follow a link to, interact with, or use a social-media platform, that platform may collect information under its own privacy policy and terms. We do not control the privacy practices of those platforms.

If social-media sharing tools, embedded feeds, pixels, or other integrations are added to the Site in the future, those features may permit the relevant provider to collect information about your interaction with the Site. We will update our disclosures where appropriate if our use of such technologies materially changes.

10. ARTWORK, PRODUCTS, THIRD-PARTY MARKETPLACES, AND PRINT-ON-DEMAND SERVICES

Hearts Dream Design currently may provide links to artwork or products available through third-party services such as Spoonflower. The Company may in the future link to additional marketplaces, manufacturers, print-on-demand providers, stationery or journal companies, card or print companies, retailers, fulfillment providers, or other third-party sellers carrying products featuring Hearts Dream Design artwork.

A link appearing on heartsdreamdesign.com does not necessarily mean that the purchase itself occurs from Hearts Dream Design.

When you click a link that takes you to a third-party marketplace, retailer, manufacturer, print-on-demand service, fulfillment provider, or other seller, you are leaving the Hearts Dream Design Site. The third party may require you to create or use an account and may collect your name, email address, login credentials, billing information, shipping address, payment information, purchase history, or other information. Your transaction may be governed by the third party's terms, privacy policy, refund policy, shipping policy, and other rules. The third party is responsible for its own collection and processing of information except to the extent it acts as our service provider.

Hearts Dream Design does not control all Personal Information collected independently by Spoonflower or by other outside marketplaces, retailers, manufacturers, or fulfillment providers to which the Site may link.

We encourage you to review the privacy policy and terms of any third-party website before creating an account, providing Personal Information, or making a purchase.

This provision is intended to cover both Hearts Dream Design’s current external marketplace links and future links to third-party sellers and print-on-demand or fulfillment partners.

11. FUTURE DIRECT ECOMMERCE AND PAYMENT PROCESSING

Hearts Dream Design may offer direct ecommerce, customer accounts, checkout functionality, or other purchasing features on heartsdreamdesign.com in the future. These features may not be active when this Privacy Policy is published.

If direct purchasing becomes available, we may collect information reasonably necessary to process an order, such as name, email address, billing address, shipping address, order information, transaction information, and customer-account information.

Hearts Dream Design intends to use an appropriate third-party payment processor or ecommerce provider for payment-card processing rather than intentionally storing complete payment-card information itself.

The payment processor's own privacy policy and terms will apply to information it processes.

When Hearts Dream Design activates direct ecommerce, we will review and update this Privacy Policy as appropriate to identify material new ecommerce, payment, account, shipping, or fulfillment practices and providers.

12. COURSES, WORKSHOPS, EDUCATIONAL MATERIALS, AND FUTURE OFFERINGS

Hearts Dream Design may from time to time offer courses, workshops, classes, demonstrations, educational materials, guides, downloadable resources, or other creative-learning opportunities. Some of these offerings may not yet be available when this Privacy Policy is published.

If you register for or purchase such an offering, we may collect information reasonably necessary to register you, communicate with you, provide access to the offering, process payment, deliver materials, administer the program, provide customer service, and maintain appropriate business records.

If future courses or educational offerings introduce a course platform, membership system, student login, payment processor, community platform, or other material new data-processing service, Hearts Dream Design will review this Privacy Policy and update it as appropriate.

13. ACCOUNTS AND PASSWORDS

If the Site offers customer, student, member, or other accounts in the future, you may be asked to create login credentials. You are responsible for maintaining the confidentiality of your username and password and for taking reasonable precautions against unauthorized access to your account.

Please notify us promptly if you believe your account or login credentials have been compromised.

Account functionality may not be available on heartsdreamdesign.com at the time this Privacy Policy is published.

14. HOW WE SHARE PERSONAL INFORMATION

We may disclose Personal Information when reasonably necessary to website hosting and technology providers; analytics providers; email and newsletter providers; form providers; ecommerce providers; payment processors; shipping and fulfillment providers; customer-service providers; course or educational platforms; contractors or service providers assisting in business operations; attorneys, accountants, bookkeepers, insurers, consultants, and other professional advisers; government agencies, regulators, courts, law enforcement, or other parties when required or permitted by law; parties involved in protecting our rights, safety, security, property, users, or others; a purchaser, successor, or other appropriate party in connection with a merger, sale, financing, reorganization, acquisition, or transfer of all or part of the business; or another party when you direct us or consent to the disclosure.

Current service-provider categories relevant to Hearts Dream Design include website hosting and built-in website technology through Hostinger and email/newsletter services through Kit.

We may also provide links that allow you to interact directly with Spoonflower and other third-party marketplaces or sellers, as described above.

We do not sell Personal Information for money.

Hearts Dream Design does not currently use Personal Information for third-party behavioral advertising or intentionally “sell” or “share” Personal Information for cross-context behavioral advertising as those terms may be defined under California privacy law.

If our practices change in a way that constitutes a legally regulated sale, sharing, targeted advertising practice, or similar activity, we will update this Privacy Policy and provide applicable notices and opt-out mechanisms.

15. SERVICE PROVIDERS

We use third parties to perform certain functions necessary to operate our business. Those providers may process Personal Information in connection with providing their services.

Known services at the time of this Privacy Policy include Hostinger for website hosting, website infrastructure, and associated built-in website functionality and analytics; Kit (formerly ConvertKit) for newsletter signup and email-list/newsletter services; and Spoonflower as an external marketplace to which Hearts Dream Design may link for products featuring Hearts Dream Design artwork.

Additional third-party marketplaces, print-on-demand companies, retailers, fulfillment providers, course platforms, ecommerce services, or payment processors may be added as Hearts Dream Design expands its offerings.

Where a company operates independently rather than solely as our service provider, its own privacy policy governs its independent collection and use of your information.

16. THIRD-PARTY LINKS

The Site may contain links to websites, social-media platforms, marketplaces, articles, resources, manufacturers, retailers, print-on-demand providers, or other third-party services.

Third-party websites have their own privacy practices and terms. We are not responsible for the content, security, availability, or independent privacy practices of websites we do not control.

A link does not necessarily constitute an endorsement of every practice of the linked party.

17. DATA SECURITY

We use reasonable administrative, organizational, and technical measures designed to protect Personal Information appropriate to the nature of the information and our business.

heartsdreamdesign.com uses HTTPS/SSL technology to protect information transmitted between a visitor's browser and the Site where supported by the Site infrastructure.

Access to Personal Information is limited to people and service providers who reasonably require access for legitimate business purposes.

However, no website, email system, internet transmission, database, or storage system can be guaranteed to be completely secure. You provide information electronically at your own risk, subject to rights that cannot lawfully be waived.

Hearts Dream Design does not ask customers to send complete credit-card information through ordinary email.

If we become aware of a data breach requiring notification, we will take reasonable responsive action and provide legally required notifications within the time and manner required by applicable law.

18. DATA RETENTION

We retain Personal Information for only as long as reasonably necessary for the purposes for which it was collected, including to provide requested services, maintain newsletter subscriptions, administer business relationships, maintain transaction and licensing records, fulfill contracts, resolve disputes, protect legal rights, prevent fraud or abuse, comply with tax, accounting, regulatory, or other legal obligations, and maintain records reasonably necessary for legitimate business purposes.

Different categories of information may therefore be retained for different periods.

For example, Hearts Dream Design may need to retain licensing agreements, transaction records, invoices, and related business correspondence after an individual project has ended in order to document artwork rights, permitted uses, financial transactions, and contractual obligations.

Newsletter information may be retained while you remain subscribed and for an appropriate period afterward as necessary to maintain suppression/unsubscribe records or comply with applicable law.

When Personal Information is no longer reasonably required, we may delete, anonymize, or otherwise appropriately dispose of it, subject to legal and legitimate record-retention requirements.

19. YOUR CHOICES AND PRIVACY RIGHTS

Depending on where you live and the laws applicable to the Company and your information, you may have rights concerning your Personal Information. 20. CALIFORNIA PRIVACY RIGHTS

Hearts Dream Design LLC is based in California.

California residents may have privacy rights under laws including the California Online Privacy Protection Act (“CalOPPA”) and, where applicable to the business and processing involved, the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”).

The availability and scope of particular statutory rights depends on whether the applicable law applies to the business and the relevant processing activity.

Hearts Dream Design does not represent through this Privacy Policy that it presently meets the statutory business thresholds that would make every provision of the CCPA/CPRA applicable to the Company.

Where applicable, California privacy rights may include rights to know, access, correct, or delete Personal Information and rights concerning certain sales or sharing of Personal Information.

Hearts Dream Design does not sell Personal Information for money and does not currently intentionally share Personal Information for cross-context behavioral advertising.

21. EUROPEAN ECONOMIC AREA, UNITED KINGDOM, AND OTHER INTERNATIONAL VISITORS

Although Hearts Dream Design is located in California, the Site is accessible to visitors outside the United States and Hearts Dream Design does not intentionally restrict its audience to U.S. visitors.

Where the General Data Protection Regulation (“GDPR”), UK GDPR, or another applicable privacy law applies to our processing, Personal Information may be processed on one or more lawful bases, including your consent, performance of a contract or steps requested before entering into a contract, compliance with a legal obligation, or our legitimate interests, provided those interests are not overridden by applicable privacy rights.

Hearts Dream Design may offer artwork, products, creative content, classes, or educational material that families or children could enjoy without making the Site itself a service directed to children or intentionally collecting children's Personal Information.

If the Company later offers an online service specifically directed to children or intentionally collects Personal Information from children in circumstances governed by the Children's Online Privacy Protection Act (“COPPA”) or similar laws, we will establish appropriate parental-consent and privacy procedures before doing so.

24. LICENSING COMMUNICATIONS AND BUSINESS RECORDS

Because artwork licensing is a core business activity of Hearts Dream Design, information submitted in connection with a licensing inquiry may become part of the Company's business records.

We may use and retain such information to identify the requesting company or individual, evaluate proposed artwork use, correspond regarding a project, prepare proposals or agreements, negotiate licensing terms, document artwork selected or reviewed, administer exclusivity or permitted-use restrictions, invoice and receive payment, track contractual obligations, document license history, and protect or enforce intellectual-property and contractual rights.

Deletion of ordinary marketing information does not necessarily require Hearts Dream Design to delete records that must reasonably be retained to establish an existing or historical artwork license, transaction, contractual obligation, intellectual-property right, accounting record, or legal claim.

25. LEGAL DISCLOSURE AND PROTECTION OF RIGHTS

We may use, preserve, or disclose information when we reasonably believe doing so is necessary or appropriate to comply with applicable law, respond to lawful legal process, cooperate with lawful government or regulatory requests, investigate suspected fraud, abuse, or security problems, enforce contracts or Site terms, protect intellectual-property rights, protect the rights, property, or safety of the Company, our users, or others, or establish, exercise, or defend legal claims.

26. BUSINESS TRANSFERS

If Hearts Dream Design LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, transfer of business operations, or similar transaction, information held by the Company may be disclosed or transferred as part of that transaction, subject to applicable law.

Hearts Dream Design is an evolving creative business. Its Site may expand to include additional artwork collections, licensing services, newsletters, products, direct ecommerce, courses, workshops, downloadable materials, customer or student accounts, memberships, or relationships with additional marketplaces, manufacturers, print-on-demand providers, and fulfillment partners.

Not every future addition requires a change to this Privacy Policy. However, we will review and update the policy when a change materially affects how Personal Information is collected, used, disclosed, or processed.

In particular, Hearts Dream Design should review this Privacy Policy before activating direct ecommerce, a new payment processor, customer or student accounts, a course or membership platform, behavioral advertising, advertising pixels, substantial new analytics, or other technology that materially changes its data practices.
